§ 1. General provisions
- These terms set out how services are supplied electronically on the Multi 2 Diamonds site (the “Service”). They are the regulaminrequired by art. 8 of the Polish Act of 18 July 2002 on the supply of services by electronic means (“uśude”).
- The provider is Multi2Diamonds Bartłomiej Słupik, Borowego 37A/18, 30215 Kraków, Poland (the “Provider”). Contact: support@multi2diamonds.com.
- That address is also the point of contact for users and for authorities under art. 11 and art. 12 of Regulation (EU) 2022/2065 (the Digital Services Act). Correspondence is in Polish or English.
- These terms are made available free of charge before any contract is concluded and, on request, in a form that lets you obtain, reproduce and record them (art. 8 ust. 1 pkt 1 uśude). This page can be displayed, saved and printed at any time.
- The authoritative text is Polish. This translation is provided for information; where the two differ, the Polish version prevails.
§ 2. Definitions
- User — a natural person using the Service.
- Account — the resources and permissions assigned to a User after registration, reachable once signed in.
- Content — deals, collections, comments, messages sent at a table and anything else a User puts into the Service.
- Guest — someone who joins a table by invitation, without creating an Account.
§ 3. Types and scope of the services
- The Service exists for studying and analysing contract bridge deals. The Provider supplies the following electronically:
- reading deals and collections marked public — no Account needed;
- keeping an Account;
- recording and analysing deals, including double-dummy analysis;
- organising deals into collections and folders;
- looking up published tournament results;
- sharing deals and collections with chosen people;
- playing at a table with others, including the table chat.
- The services are supplied free of charge. Paid services will only be introduced under separate terms and with the User's prior agreement; nothing a User already uses becomes chargeable without that agreement.
- The contract for browsing the Service without an Account is concluded for a definite period and ends when the User leaves the Service.
§ 4. Technical requirements
- A device with an internet connection and a current version of a mainstream browser, with JavaScript and cookies enabled.
- An Account additionally needs a working email address at which the confirmation message can be received.
- The Provider is not liable for the Service being unusable because the requirements in (1) and (2) are not met.
§ 5. Particular risks
- As required by art. 6 pkt 1 uśude, the Provider draws attention to the particular risks of using a service supplied electronically. They include malicious software; messages or sites impersonating the Service in order to obtain a password (phishing); interception of data sent over an unsecured network; and loss of an Account after a password is disclosed to someone else.
- These risks are reduced by keeping software up to date, using a password not reused anywhere else, and signing out after using a shared device.
- The Provider puts no software or data into the User's system other than what the cookie notice describes (art. 6 pkt 2 uśude).
§ 6. Concluding and terminating the Account contract
- The Account contract is concluded for an indefinite period when the email address is confirmed by opening the link sent after registration.
- An Account may be created by a person aged 16 or over. A person without full capacity to enter into legal transactions may conclude the contract only with the consent of their legal representative (art. 17 of the Polish Civil Code); the Provider may ask for that consent to be confirmed and, if it is not, terminate the contract and delete the Account.
- The User gives true details on registration, does not disclose their password, and tells the Provider without delay if they suspect someone else has reached their Account. The User is responsible for what happens under their Account.
- The User may terminate the contract at any time, with immediate effect and without giving a reason, by asking for the Account to be deleted at support@multi2diamonds.com. The Provider deletes the Account and the Content attached to it.
- The Provider may terminate the contract on 14 days' notice, in particular if it stops supplying the services.
- Where these terms are seriously breached, in particular by supplying unlawful content, the Provider may terminate the contract with immediate effect or suspend the Account. The person affected is notified under § 9(4).
§ 7. The ban on supplying unlawful content
- Users are prohibited from supplying content of an unlawful character (art. 8 ust. 3 pkt 2 lit. b uśude).
- So that the scope of that ban is concrete, a User may in particular not:
- post content infringing personality rights, copyright or other rights of third parties, or content that is insulting, harassing or inciting hatred;
- post other people's personal data without a lawful basis;
- impersonate another player, or claim as their own a federation player id that is not theirs;
- disrupt the Service — in particular by attempting unauthorised access to data, scraping at a rate that degrades it, or circumventing the bot protection;
- use the Service to send unsolicited commercial messages (art. 398 of the Electronic Communications Law).
§ 8. User Content
- Rights in Content stay with the User.
- The User grants the Provider a free, non-exclusive licence limited to what is needed to store the Content and show it to the people the User has chosen. The licence ends when the Content or the Account is deleted.
- Marking a deal or collection public makes it readable by anyone who has its URL, signed in or not. That is publication and should be treated as such.
§ 9. Reporting illegal content, and moderation
- Anyone may report content they consider illegal to support@multi2diamonds.com. This is the notice-and-action mechanism required by art. 16 of the Digital Services Act. A report should contain:
- an explanation of why the reporter considers the content illegal;
- a precise indication of the content, in particular its URL on the Service;
- the reporter's name and email address;
- a statement that the reporter believes in good faith that the information in the report is accurate and complete.
- The Provider confirms receipt without delay and tells the reporter how the report was dealt with.
- Reports are reviewed individually, by a human. There is no automated moderation and no automated decision-making.
- Content is removed, its visibility restricted, or an Account suspended, only where the Content is unlawful or breaches § 7. The person affected is told what was done and why (art. 17 of the Digital Services Act) and can contest it by replying to that message.
§ 10. Complaints procedure
- Complaints about the services are sent to support@multi2diamonds.com.
- A complaint should identify the User (username, or the email address on the Account), describe what is wrong, and say what the User would like done about it.
- The Provider answers within 14 days of receiving the complaint, to the address it came from. If that is not possible, the Provider says why and when an answer can be expected.
- A User who is a consumer may seek help from a municipal or district consumer ombudsman (rzecznik konsumentów) or from the regional inspector of the Trade Inspection. Using those routes is voluntary.
§ 11. Availability and liability
- The Provider works to keep the Service available and correct, but the services are free of charge and uninterrupted operation is not guaranteed. Maintenance windows may be necessary.
- Double-dummy analysis and imported tournament results are provided for study. Results are reproduced as the organiser published them and may carry errors from the source.
- Nothing here excludes or limits liability where that is not legally permitted — in particular for damage caused intentionally (art. 473 § 2 of the Polish Civil Code) and for liability towards consumers under mandatory provisions of law.
§ 12. Personal data
Personal data is handled as set out in the privacy policy, and what is stored on your device in the cookie notice. Both form part of your relationship with the Provider.
§ 13. Changes to these terms
- The Provider may change these terms for good reason: a change in the law, a change in the scope or manner of the services, or the need to remove an ambiguity.
- Users with an Account are told by email at least 14 days before a change takes effect, and the new version is published on this page.
- A User who does not accept a change may terminate the contract before it takes effect, under § 6(4).
§ 14. Final provisions
- Matters not covered here are governed by Polish law, in particular the Civil Code and uśude.
- That choice of law does not deprive a consumer of the protection of the mandatory rules of the country of their habitual residence, nor of the right to bring a claim before the courts competent for their place of residence.
